WORKFLOW FOR SIMPLIFIED DIVORCES
1) Consultation. Your first meeting with us where we will understand your grounds for divorce and the ancillary matters . We will take copies of documents from you such as your marriage certificate and children's birth certificate.
2) We prepare the draft divorce papers for you to review. If you are satisfied with the draft documents, we will proceed to send a letter enclosing the draft divorce papers to your spouse for his or her consideration.
3) We meet you and your spouse for the signing of the divorce papers.
4) We file the divorce papers in Court. There is no need for personal service of the divorce papers on your spouse as he or she would have consented to the dispensation of service of divorce papers. However, we do furnish a copy of the documents to your spouse as well.
5) The Courts fix an uncontested divorce hearing date where parties attendance is dispensed with and the Interim Judgment is granted upon all the Courts being satisfied that the divorce is in order.
6) Final Judgment is granted 3 months later. The whole process therefore takes about 4 months from start to the end.
WORKFLOW FOR PROBATE MATTERS
Applications for Grant of Probate or Letters of Administration
1) Consultation. Your first meeting with us where we will explain the Probate process to you, take documents such as Wills, death certificates and NRICs from you.
2) 2nd meeting: We prepare the Letters of Authorisation to make enquiries with bank and insurance companies on the assets of the Deceased. The Executor or Administrator will sign the Administration Oath and the Letters of Authorisation.
3) We file the Probate application in Court and if there is a Will, we will submit the original Will for inspection by the Courts.
4) 2 weeks later, when the Statement, death certificate and Will (if there is one) is approved, we will file the supporting affidavit which you will be signing at our office.
5) Order in Terms of the Probate or application for Letters of Administration is granted.
6) We proceed to send out the enquiries to the banks and insurance companies to ascertain the value of the Deceased's assets i.e. the value of the Estate as at date of death.
7) We prepare the Schedule of Assets-Supplementary affidavit for your signature at our office.
8) The Grant of Probate and Letters of Administration is extracted.
